Committee of Adjustment

THAT this hearing is hereby called to order at 5:30 p.m.

That the agenda be accepted as presented .

That Application B1/22 from Johanna & Peter Duthie, & their agent Dean Martin, for consent for severance of a vacant lot (lot 29) on Crystal Beach Ave to increase neighboring lot sizes (lot 28 & lot 30) municipally known as 1977 and 1979 Crystal Beach Ave is set before the Committee of Adjustment for the Municipality of Shuniah on April 6, 2022 Application B1/22 is hereby approved. If Denied: for the following reasons, If Approved: This decision is subject to the following conditions, That a registered legal description of the subject lands is received by the Secretary- Treasurer. That the owner of Lot 28 purchases the shoreline in front of their portion of Lot 29. That the provision of Subsection 50(3) and (5) of the Planning Act shall apply to any subsequent conveyance or transaction of the land and the Secretary-Treasurer’s Certificate under subsection 53(42) shall contain reference to this stipulation as it applies to the parcel of land being severed and directly abutting the parcel described as Plan M100 Lot 30 to which it is to be joined. That the provision of Subsection 50(3) and (5) of the Planning Act shall apply to any subsequent conveyance or transaction of the land and the Secretary-Treasurer’s Certificate under subsection 53(42) shall contain reference to this stipulation as it applies to the parcel of land being retained and directly abutting the parcel described as Plan M100 Lot 28 to which it is to be joined. That Application B2/22 from Bastian & Ena DePeuter, & their agent Nick Melchiorre, for consent for an easement over 409 West Loon Drive to allow for road access to 415 West Loon Drive is set before the Committee of Adjustment for the Municipality of Shuniah on April 6, 2022 Application B2/22 is hereby approved. If Denied: for the following reasons, If Approved: This decision is subject to the following conditions, That a registered legal description of the subject lands is received by the Secretary-Treasurer.
