Committee of Adjustment

THAT this hearing is hereby called to order at 5:33 p.m.

That the agenda be accepted as presented .

That application B3-22 from Basil Sandy Smith, Lorraine Smith, Andrea Smith, The Estate of Basil Smith, and their agent Ryan Bodnar for consent for severance of a vacant lot with frontage off of Mount Baldy Road to create a new lot with access off of Hwy 527 to is hereby approved If denied: for the following reason, If approved: for the following reason and is subject to the following conditions, That 5% cash-in-lieu of the value of the land be paid to the Municipality with respect to the severed lot. That a registered legal description of the subject lands is received by the Secretary- Treasurer. That any portions of the applicant’s property upon which the existing road known as Mount Baldy Road is presently situated, is deeded to the municipality at no charge, and that the solicitor for the applicants certify, or undertake upon closing to certify, that the title to those lands is free and clear of all encumbrances, and that the municipality has good and marketable title. A letter shall be received from the governing authority being the Municipality of Shuniah’s Manager of Operations or the Ministry of Transportation indicating that satisfactory arrangements have been made with respect to access/driveway location for both the severed and retained lots. That approval for a Class IV Septic System is received from the Thunder Bay District Health Unit for both the severed and retained lots. That the Secretary-Treasurer shall receive a written

THAT the Minutes of the Committee of Adjustment hearing held on August 10, 2022 be adopted as circulated and that same be filed in the Clerk's Office.
